REGISTRATION PROCESS OF FOREIGN LAWYERS TO THE BAR ASSOCIATION IN GERMANY
BAR APPLICATION AND REGISTRATION PROCESS IN GERMANY
According to German Federal Law, it is possible for lawyers registered with the bar associations of countries belonging to the World Trade Organization to register with the bar association in Germany. Turkey also falls within this scope, and according to this procedure regulated by Article 206 of the Bundesrechtsanwaltsordnung (BRAO), foreign lawyers may provide legal advice and open offices in Germany, provided that they fulfill the necessary conditions and only practice in the field of their own country's law and international law. At this stage, it should be underlined that the bar associations of some cities require a residence requirement in Germany in order to register with the bar association in that city. However, this requirement does not exist in all cities; for example, the Berlin Bar Association requires a residency requirement, while the Düsseldorf Bar Association does not. Please contact the Lotus Legal Team for more information and to find out more about the requirements for bar registration in your city.
It is important to note that once a foreign lawyer is registered with the German bar association in the city of his/her choice, he/she is obliged to submit a certificate of activity from his/her country of origin (Turkey for Turkish lawyers) to the bar association in Germany every year.
In case of an agreement with Lotus Legal, our team will provide you with a complete list of the documents you need to prepare. From the time the documents are submitted to the bar association, it takes approximately 3 months for the bar association to consider the application. Of course, this period is approximate and may be longer or shorter depending on the workload at the bar association or the possibility of the application coinciding with the Christmas - Easter period.
APPLICATION PROCESS FOR RESIDENCE PERMIT IN GERMANY
As explained above, there are some advantages for Turkish lawyers to apply for bar registration in Germany. The most important of these is that the German bar license (Urkunde) constitutes the for a possible residence Application in Germany. This is because, if you apply for residence as a self-employed person, you will be asked for a detailed plan regarding the line of business in which you will operate and you will need to prove this plan. In this context, the bar license you will obtain and the office you will open in Germany are of great importance in the acceptance of your residence request.
